For the third year in a row, two veteran attorneys at Chain | Cohn | Stiles have been recognized in the Best Lawyers in America program, the oldest and among the most respected attorney ranking services in the world.

David K. Cohn, managing partner at the law firm, was selected once again into the personal injury litigation category, while James A. Yoro, senior partner at the firm, was selected into the workers’ compensation law listings. Both attorneys were selected into the 2018 and 2019 program listings. This year they are also the only two attorneys in the greater Kern County area to be listed.

Attorneys named to the U.S. News & World Report’s “The Best Lawyers in America” are recognized by their peers in the legal industry for their professional excellence in specific practice areas. For the 2020 edition of The Best Lawyers in America, more than 8.3 million votes were analyzed, which resulted in more than 62,000 leading lawyers being included in the new edition, about 5 percent of lawyers in private practice in the United States. Of the 100 leading lawyers recognized by U.S. News & World Report’s The Best Lawyers in America 2020 edition, only two Kern County attorneys were represented.

Attorneys James Yoro and David Cohn, both partners and veteran attorneys at Chain Cohn Stiles, were recognized by one of the United States’ most honored and respected attorney-ranking systems.

Yoro and Cohn, both Bakersfield natives, stayed in the area after they received their law degrees. Cohn began practicing law in 1976, and Yoro began in 1979, and the entirety of their careers has been at Chain Cohn Stiles.

Their careers have impacted the Kern County community in a positive light — and they continue to make great strides in helping others.

‘A more positive and safer environment’

Cohn saw practicing law as a way to help others in need.

His uncle, Milt Younger, was a local lawyer who practiced personal injury law. The work he did inspired Cohn to follow in his footsteps, he said.

“Personal injury just seemed to be an area where I knew I could help the everyday person against insurance companies and big corporations,” Cohn said.

Since then, Cohn’s career has flourished, and he’s been able to create positive change in the community through litigation. Cohn, for example, represented the young son of James Moore, who died as a result of a severe beating in the Kern County Jail in 2006. Moore was mentally ill.

Cohn said he was able to establish in court that deputies from the Kern County Sheriff’s Office used excessive force on Moore.

“We were able to obtain a significant settlement against the (Sheriff’s Office) for Moore’s son,” Cohn said, noting that two deputies were also convicted and sent to prison for the beating. “Following the completion of the case, the (Sheriff’s Office) reviewed and revised their procedures for how to handle mentally ill detainees in jail.

“These types of changes, I hope, create a more positive and safer environment for the public.”

Representing the average working person 

Yoro has been managing Chain Cohn Stiles’ workers’ compensation practice full time for about 30 years. The firm has a long-standing tradition of representing injured workers, he said.

In his 30 years, Yoro has argued cases before the Ninth Circuit Court of Appeals and before the California Supreme Court. But one of the most inspirational cases he’s worked was a disability case he won for a farmworker who worked all his life in the fields. Yoro said the man would have been destitute without the benefits he won in the lawsuit.

“After the hearing was over and I told him that the judge had ruled in his favor, he and his family hugged me and said to me in Spanish, ‘gracias por darnos esperanza,'” meaning “thank you for giving us hope” in English, Yoro said. “As a lawyer, you can never take for granted the impact or influence you can have on someone’s life.”

Yoro appreciates how Chain Cohn Stiles represents the average working man and woman.

“We don’t represent big corporations or insurance companies,” Yoro said. “That guiding principle has always served our mission statement. Our clients deserve the best representation we can give them.”

Fourth of July Safety: Even legal fireworks (including sparklers) can be dangerous

As the sun starts to set on Fourth of July, Kern County streets start to shine bright with multi-colored fountains of light and flashes. But a celebration of our nation’s independence can turn tragic quickly without proper fireworks safety measures.

In fact, did you know about 11,000 people are treated in U.S. hospital emergency rooms for fireworks-related injuries each year. And in the month surrounding July 4, our nation sees about 200 fireworks injuries per day, according to the U.S. Consumer Product Safety Commission.

Despite the dangers of fireworks, few people understand the associated risks: serious burns, eye injuries, structure fires, and even death.

In 2017, for example, eight people died in our country and over 12,000 were injured badly enough to require medical treatment after fireworks-related incidents. Of those, 50% of the injuries were to children and young adults under the age of 20. While the majority of these incidents were due to amateurs attempting to use professional-grade, homemade or other illegal fireworks or explosives, an estimated 1,200 injuries were from less powerful devices like small firecrackers and sparklers, according to the National Fire Protection Association.

Injuries to people aside, fireworks start an average of 18,500 fires each year, including 1,300 structure fires and 300 vehicle fires.

Even sparklers, popular among young children, can be dangerous — much more than most people think. Sparklers burn at about 2,000 degrees, hot enough to melt some metals, and can quickly ignite clothing. Many children have received severe burns from dropping sparklers on their feet. In fact, sparklers account for more than 25% of emergency room visits for fireworks injuries, and nearly half of injuries for children under 5 years old, according to the National Safety Council. Alternatives include glow sticks, confetti poppers or colored streamers.

Chain | Cohn | Stiles advises everyone to enjoy fireworks at public displays conducted by professionals. They may be legal in Kern County, but they are not necessarily safe.

But if you do take part and celebrate the Fourth of July with legal fireworks, here are some safety tips to keep in mind:

  • Never allow young children to play with or ignite fireworks.
  • Always have an adult supervise fireworks activities.
  • Never place any part of your body directly over a fireworks device when lighting the fuse. Back up to a safe distance immediately after lighting fireworks.
  • Only use fireworks outdoors in a clear area, and away from buildings and vehicles.
  • Never try to re-light or pick up fireworks that have not ignited fully.
  • Never point or throw fireworks at another person.
  • Keep a bucket of water or a garden hose handy in case of fire or other mishap.
  • Light fireworks one at a time, then move back quickly.
  • Never carry fireworks in a pocket or shoot them off in metal or glass containers.
  • After fireworks complete their burning, douse the spent device with plenty of water from a bucket or hose before discarding it to prevent a trash fire.
  • Never use fireworks while impaired by drugs or alcohol.
  • Never light them indoors.
  • Never use illegal fireworks. Plus, fire departments in both Bakersfield and Kern County hand out fines of $1,500 and up for illegal firework activity.

If someone is injured by fireworks, here’s what you can do:

  • If an eye injury happens, don’t let the injured person touch or rub it, as this may cause even more damage. Don’t flush the eye out with water or try to put any ointment on it. Cut out the bottom of a paper cup, place it around the eye, and get medical care right away — eyesight may depend on it.
  • If someone suffers a burn, remove clothing from the burned area, and call your doctor immediately.
  • If someone is injured due to the negligence of someone else, please contact Chain | Cohn | Stiles immediately to receive legal assistance, be compensated for injuries suffered, and continue to get medical care in the future.

Chain | Cohn | Stiles in recent years has represented victims of fireworks accidents and other burn injury cases. In 2014 attorney David Cohn represented two men who suffered from severe injuries caused in a fireworks accident while attending a party on Fourth of July in west Bakersfield. The two men arrived at the party where party-goers were allegedly setting off illegal fireworks and explosives. A blast injured two clients, and the case settled in 2018 for $2.3 million.

Chain | Cohn | Stiles inducted into first Best of Kern County Hall of Fame class, selected to ‘Best Law Firm’ list

Chain | Cohn | Stiles has been inducted into the inaugural Best of Kern County Hall of Fame, awarded to men, women, businesses, and organizations with a long history of excellence in their respective fields, and who also give back to our community.

In addition, the Bakersfield-based law firm has been selected by people in Kern County as a favorite in the “Best Law Firm” category of the annual Best of Kern County Readers’ Choice Poll by The Bakersfield Californian, unveiled recently in Bakersfield Life Magazine.

“We do what we do because we care about our community, and the people in it,” said David Cohn, managing partner at Chain | Cohn | Stiles. “This is our hometown. We want to make sure we help our local residents in and out of our office.”

Cohn continued: “We don’t do legal work or community goodwill to receive accolades. Still, we want to thank the people of Kern County for voting us into the Best Law Firm category year after year, and also Bakersfield Life Magazine for selecting us into the first Hall of Fame class. We sincerely appreciate it.”

This is the seventh year in a row that the law firm has been selected into the “Best Law Firm” category — each year since the category was introduced to The Bakersfield Californian’s Readers’ Choice Poll. But for more than 25 years, TBC Media has conducted the Best of Readers’ Choice Poll to showcase the people, places and things that make Kern County truly unique.

This year, the poll received 100,000 nominations and nearly 325,000 votes.

Chain | Cohn | Stiles was one of three inductees in the inaugural Hall of Fame class, announced during a Bakersfield Life Magazine reception. Ten local companies were nominated for the Hall of Fame. Joining the law firm was Urner’s, a local furniture store celebrating 100 years this year, and Jim Burke Ford, a local Ford dealership and one of the largest such dealerships in the country.

While these three businesses are different, their community giving is what makes them all similar. Chain | Cohn | Stiles is commemorating 85 years of helping accident and injury victims in Bakersfield. The law firm works closely with Mothers Against Drunk Driving, Kern County, to help DUI crash victims, raise awareness of DUI crimes, and provide educational programs locally. The law firm also partners with Bike Bakersfield year after year to donate hundreds of safety helmets and bicycle lights to students and bike riders in areas of Kern County that need them the most.

Most recently, Chain | Cohn | Stiles donated $10,000 to the Bakersfield Homeless Center in an effort to combat our community’s homeless epidemic.

Chain | Cohn | Stiles donates $10,000 for Bakersfield Homeless Center jobs program

Chain | Cohn | Stiles law firm has donated $10,000 to the Bakersfield Homeless Center in an effort to combat our community’s homeless epidemic.

The donation will go toward the homeless center’s job skills training program and street cleaning team focusing on downtown Bakersfield. In short, the program helps homeless center residents move forward with their lives while making a difference in our community. The program is designed to be a transitional program, where participants gain real-world skills, build confidence, and develop experience to find long-term employment.

The donation comes on the heels of a Kern County Homeless Collaborative report that found a 50 percent increase in the local homeless population over last year’s count, with over 1,330 people locally experiencing homelessness. Large efforts by City of Bakersfield and Kern County to tackle the issue are underway.

“Sadly, we see the effects of homelessness every day on the streets in downtown Bakersfield and outside our own office,” said David Cohn, managing partner of the law firm. “If there is something we can all do to help homeless center residents out of homelessness, while at the same time making sure our city is presented as the jewel that it is, then we should all help. All downtown businesses are impacted by homelessness, and I would encourage others to step forward, and help support a solution.”

Currently, there are more than 80 people participating in the homeless center’s jobs program. The Downtown Street Ambassadors program was first implemented by the Downtown Bakersfield Development Corporation in partnership with Bakersfield Homeless Center, Garden Pathways, The Mission at Kern County and Keep Bakersfield Beautiful.

The donation also falls on the 85-year anniversary for Chain | Cohn | Stiles, which has been housed consistently in downtown Bakersfield during its history – from the Haberfelde Building, to the Sill Building, Bank of America, and its current home today.

Chain | Cohn | Stiles files claims on behalf of 3 students who were victims of sexual misconduct at local high school

Chain | Cohn | Stiles law firm has filed claims on behalf of three students who were victims of sexual misconduct at North High School.

Kern County Sheriff’s Office has arrested Edwin Rodriguez on suspicion of lewd and lascivious acts with minors 14 to 15 years old, exhibiting harmful matter to a minor, annoying a child under 18 and false imprisonment. Local media reported 10 people came forward to investigators alleging inappropriate physical contact and other unwanted interaction by Rodriguez while he worked as an athletic equipment manager at North High School.

Chain | Cohn | Stiles, after speaking with victims and investigators, suspects there could be even more victims. According to the victims, Rodriguez would give students sodas and candy, befriend them on the social media, and send them sexually explicit photos and videos, among other sexual misconduct that took place over several years. One of the women is 19 years old, and the abuse first occurred when she was a sophomore in high school.

In one instance, Rodriguez sent a photo on Snapchat to two of the girls that showed him wearing shorts and a tank top and grabbing his penis. A number of text messages sent by Rodriguez to the girls told them he thought they were “hot” or commented on various parts of their body he found attractive.

The mother of one of the victims has also spoken out.

“This sick man manipulated my daughter. She and I are very close, but she felt she was doing something wrong and was afraid to tell me about it,” said the mother of one of the victims in a statement. “My hope through this lawsuit is to prevent this from happening in the future, and to protect our students through better accountability and scrutiny of school officials.”

Added Cohn: “We want to get to the bottom of how this went on for so long.”

“I think all the markers were out there,” Cohn told KGET-17. “It will be interesting to listen to the district’s explanation for why they didn’t do something sooner.”

Chain | Cohn | Stiles attorneys and the parents of the victims advise other parents to talk to their children about boundaries with those authority.

“Take this opportunity to have a discussion with your teenager,” Cohn said. “Students should never have one-on-one conversations through social media or text messages with school personnel, coaches, or other adults in authority. And encourage them to speak up if someone in authority contacts them privately or crosses a line.”

Citing similar cases that have occurred in the past few years, Cohn told local media that a message must be sent to the school district that this type of behavior won’t be tolerated.

“A the end of the day, what really has an impact on the school district is getting hit in their pocketbook,” Cohn said.

Two veteran attorneys at Chain | Cohn | Stiles have been recognized in the 2019 Best Lawyers in America program, which is the oldest and among the most respected attorney ranking services in the world.

David K. Cohn, managing partner at the law firm, was selected once again into the personal injury litigation category, while James A. Yoro, senior partner at the firm, was selected into the workers’ compensation law listings. Both attorneys were selected into the 2018 program.

Attorneys named to the U.S. News & World Report’s “The Best Lawyers in America” are recognized by their peers in the legal industry for their professional excellence in specific practice areas. For the 2019 edition of The Best Lawyers in America, the 25th edition, more than 7.8 million votes were analyzed, which resulted in nearly 60,000 leading lawyers being included in the new edition. Lawyers are not required or allowed to pay a fee to be listed, and inclusion in Best Lawyers is considered a singular honor.

Chain | Cohn | Stiles has unveiled a new “Audio Center” web page aimed to keep listeners in the loop on the latest news in personal injury and workers’ compensation law.

The new web page contains interviews with Chain | Cohn | Stiles’ own attorneys sitting in with some of Bakersfield’s and Kern County’s leading radio personalities. Among the interviews are as follows:

They explore two areas in investigating the question of civil liability: the waiver ostensibly signed by each 5K participant, and a legal doctrine known as “assumption of risk.”
  • Workers’ compensation associate attorney Beatriz Trejo joined “El Show De Cascabel,” a Spanish language show on La Caliente 96.9, and answered questions from listeners, how to handle employers who threaten to fire employees who report issues they may be having at work, how to properly handle paperwork related to work injuries, and much more.   • Workers’ compensation attorney and senior partner Jim Yoro discusses various work injury issues with DJ Sheri Ortiz on The Groove radio station. They focus on valley fever, and how you could be entitled to benefits under the workers’ compensation system if you get ill on the job, and the illness is as a result of the job.
  • Lawyer Matt Clark appeared on KERN Radio to discuss controversial comments made by Kern County Sheriff Donny Youngblood, wrongful death lawsuits, and excessive force cases. A video showed Sheriff Youngblood telling an employees union that it is better “financially” to kill suspects than to “cripple” them has sparked controversy locally and nationwide.
